Welcome to My Material Warehouse ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of https://www.mymaterialwarehouse.com (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. General
- Eligibility: You must be at least 18 years old or have legal authorization to use the Service.
- Changes: We may modify these Terms at any time. Changes are effective upon posting to the Service. Significant changes will be communicated via email or a pop-up on the Service. You are responsible for periodically reviewing the Terms for updates.
- Compliance: You agree to comply with all applicable laws, including consumer protection laws in your jurisdiction and where you purchase products.
2. Purchases
- Order Process: To make a purchase, you must provide accurate information (e.g., name, address, email, phone). We accept payments via Visa, Mastercard, PayPal, Shopify Payments, Discover, and American Express.
- Order Acceptance: All orders are subject to our approval. We may refuse or cancel orders due to product unavailability, suspected fraud, or other reasons.
- Pricing: Prices are in USD and exclude taxes and shipping unless stated. We may correct pricing errors and offer you the option to proceed or cancel.
- Taxes: You are responsible for applicable sales, use, or other taxes.
- Payment Disputes: You agree to resolve payment disputes directly with your payment provider.
- Quote Validity: Quotes and volume-based pricing provided by My Material Warehouse are valid for 30 calendar days from the date issued. After 30 days, quoted prices are subject to change without notice. To place an order against a quote, contact us at support@mymaterialwarehouse.com or (800) 567-5358 before the expiration date.
- Tax-Exempt and Resale Purchases: If you are a tax-exempt entity or hold a valid resale certificate, you may request a tax-exempt invoice prior to placing your order. To do so, email your exemption certificate or resale certificate along with a description of the products you intend to purchase to support@mymaterialwarehouse.com. Our sales team will review your documentation and issue a custom quote or invoice reflecting the appropriate tax treatment. We are unable to retroactively adjust taxes on orders that have already been placed and paid through the standard checkout process. It is your responsibility to request tax-exempt invoicing before completing your purchase.
3. Shipping and Delivery
- Free Shipping: My Material Warehouse offers free shipping on all orders that are eligible for standard or freight delivery to the continental United States. Certain products are pickup-only and cannot be shipped — these items are fulfilled exclusively through in-person pickup at a designated distribution warehouse and are clearly identified as such on their product pages. A prominent example is Versetta Stone, which is available for pickup only and is not eligible for shipping. The free shipping offer does not apply to pickup-only products. Pickup-only orders are subject to the Local Pickup and Abandoned Orders terms set forth in Section 4.
- Shipping: We ship to the continental United States only (no Alaska, Hawaii, or outlying territories without prior approval). Shipping costs and estimated delivery times are provided at checkout.
- Backorders: If a product is on backorder at the time of your order or becomes unavailable after your order is placed, we will notify you promptly with an estimated lead time. You may accept the revised timeline or cancel the order at no charge. We do not capture or hold payment for backordered items beyond the original authorization period — if the lead time changes materially, any authorization hold will be released back to your original payment method. We are not able to accept or retain funds for an order without your acknowledgment of the updated delivery timeframe.
- Risk of Loss: Ownership and risk of loss are transferred to you (the buyer) upon delivery to the carrier. We ensure products are in good condition when delivered to the shipping carrier, with documentation available upon request.
- Incorrect Addresses: You confirm the shipping address is accurate and accessible for delivery. You are responsible for incurred re-delivery costs resulting from improperly provided shipping information, including errors in address, neglecting to mention accessibility issues inhibiting delivery by truck, or lack of adequate contact information. Re-delivery costs are based on actual charges assessed by the carrier, and documentation of these costs is available upon request.
3a. Freight and Hazardous Materials Shipping
Certain products sold by My Material Warehouse are large, heavy, or otherwise classified as freight shipments and may be subject to special handling, delivery, and liability terms.
- LTL Freight Shipments: Large or heavy items are shipped via Less-than-Truckload (LTL) freight carriers. Freight deliveries are made to a curbside or loading dock and do not include inside delivery, up-floor delivery, or assembly unless otherwise stated at checkout. You are responsible for arranging adequate personnel or equipment to receive and move freight upon delivery.
- Delivery Accessibility: You must ensure the delivery location is accessible to a standard freight truck (typically 53 feet in length). If a delivery cannot be completed due to access restrictions you failed to disclose, you will be responsible for any re-delivery, storage, or return freight charges incurred.
- Inspection at Delivery: You must inspect all freight shipments for damage at the time of delivery, before signing the carrier's delivery receipt. If damage is found, you must note it clearly on the delivery receipt and contact us within 48 hours at support@mymaterialwarehouse.com or (800) 567-5358. Signing the delivery receipt without notation of damage may limit or void your ability to file a freight damage claim.
- Hazardous Materials: Some products may be subject to hazardous materials regulations during transport (e.g., adhesives, solvents, or chemical compounds). Such items are shipped in compliance with applicable U.S. Department of Transportation (DOT) regulations. Hazardous materials shipments may be subject to additional carrier surcharges, shipping restrictions, or longer lead times. We will notify you of any such restrictions prior to or at the time of your order.
- Carrier Liability: Once a shipment is in the possession of the freight carrier, liability for loss or damage rests with the carrier. We will assist you in filing freight claims where applicable, but we are not responsible for carrier delays, damage in transit, or loss after the shipment has been tendered to the carrier.
4. Local Pickup and Abandoned Orders
- Local Pickup: For orders designated for local pickup or will-call, you must schedule and complete pickup within 30 calendar days after we notify you that the materials are ready.
- Notification & Final Notice: We will make reasonable attempts to contact you via email and phone. If the order is not picked up within 30 days, we will send a final notice giving you an additional 14 days to collect the materials.
- Abandoned Orders: If you fail to pick up or respond after the final notice, the order will be considered abandoned. We reserve the right to resell, repurpose, or dispose of the materials without further liability to you. Any refund, if issued, will be at our sole discretion and may be subject to processing fees, restocking, storage, and handling fees.
5. Order Cancellations
The following cancellation terms apply to all orders placed through the Service:
- Cancellation Before Shipment: You may cancel a standard order at any time before it has been shipped, with no questions asked. To request a cancellation, contact us at support@mymaterialwarehouse.com or (800) 567-5358 as soon as possible.
- Custom and Special-Order Items: Custom-made, special-order, or made-to-order items cannot be canceled once the order has been placed and confirmed. A list of non-cancellable and non-returnable products is maintained on our Returns page at https://mymaterialwarehouse.com/pages/returns.
- Cancellation After Shipment: Once an order has been picked up by the carrier, it can no longer be canceled. At that point, the order is subject to our standard Return Policy. You will be responsible for return shipping costs and any applicable restocking fees. Please refer to our Returns page at https://mymaterialwarehouse.com/pages/returns for full details.
- Partial Order Cancellations: We generally allow partial order cancellations. However, if your original order qualified for tiered or volume-based pricing, canceling part of the order may result in the loss of that pricing tier. The remaining items will be repriced at the applicable rate for the reduced quantity.
6. Returns and Refunds
- Return Policy: Products may be returned within 30 calendar days of delivery, unused, in original packaging, and in resalable condition. See our Return Policy at https://mymaterialwarehouse.com/pages/returns for detailed instructions, including the requirement for a Return Authorization Number (RAN).
- Restocking Fee: A 25% restocking fee applies to returned items that are not damaged. Before returning any goods, you must obtain prior written communication and acknowledgment from My Material Warehouse, including a Return Authorization Number (RAN). We will promptly issue a RAN upon your request via support@mymaterialwarehouse.com or (800) 567-5358. Returns without a RAN or refused by you may be subject to reduced or no refunds, at our discretion, subject to Florida law.
- Refunds: Approved refunds are processed within 7–10 business days to the original payment method. Shipping costs are non-refundable unless the product is defective. You are responsible for return shipping and handling costs for approved returns.
- Defective Products: Report apparent defects within 7 days of delivery by contacting us at support@mymaterialwarehouse.com or (800) 567-5358 with photos of the defective product and your order number. Latent defects must be reported promptly upon discovery. We will arrange a replacement or refund for verified defects.
7. Product Compatibility Disclaimer
My Material Warehouse sells a wide range of building materials, hardware, and specialty products. It is your sole responsibility to verify that any product you purchase is compatible with your intended application, existing materials, structures, systems, or local code requirements before placing an order.
- No Compatibility Guarantee: We do not warrant that any product will be compatible with your specific project, existing materials, structural conditions, or local building codes. Product descriptions, dimensions, and specifications are provided for general reference only.
- Customer Responsibility: Before purchasing, you are responsible for consulting product documentation, manufacturer specifications, and where applicable, a licensed professional to confirm suitability. If you are unsure whether a product is appropriate for your application, contact us at support@mymaterialwarehouse.com or (800) 567-5358 before placing your order.
- Vehicle and Mobility Products: Products such as van wheelchair ramps are designed for specific vehicle types and configurations. These products may not meet ADA slope or accessibility standards and are not intended for use as fixed architectural ramps. Compatibility with your specific vehicle, door configuration, floor height, or intended use is your responsibility to verify prior to purchase.
- No Returns for Incompatibility: Failure to verify compatibility before purchase is not grounds for a return or refund outside our standard Return Policy. We encourage you to confirm fit and suitability before ordering.
8. B2B and Contractor Purchases
My Material Warehouse regularly transacts with contractors, builders, designers, and other business professionals purchasing materials for commercial projects, resale, or professional installation. If you are purchasing in a business or professional capacity, the following terms apply:
- Business Purchaser Representation: By placing an order in a professional or commercial capacity, you represent and warrant that you are acting as a business entity, contractor, or professional—not as a consumer purchasing for personal, family, or household use. This representation affects the legal protections and dispute resolution options available to you.
- Waiver of Consumer Protections: To the extent permitted by applicable law, business and commercial purchasers expressly waive any rights or protections afforded solely to consumers under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) and analogous state or federal consumer protection statutes. These statutes are intended to protect individual consumers, not merchants or businesses purchasing for commercial purposes.
- Professional Responsibility for Product Selection: Contractors and trade professionals are solely responsible for selecting products appropriate for their project specifications, applicable building codes, and the intended end use. We are not liable for damages arising from product selection made by a licensed professional, improper installation, or non-compliance with local codes.
- Client Liability Indemnification: If you are purchasing on behalf of a client, you agree to indemnify and hold My Material Warehouse harmless from any claims brought by your client arising out of the product selection, installation, or project outcome. The relationship between you and your client is entirely separate from your transaction with us.
- No Cooling-Off Period for Commercial Purchases: Florida's three-day right of rescission and similar cooling-off rights are consumer protections that do not apply to commercial or business-to-business transactions. Commercial orders are final, subject to the cancellation and return terms set forth in Sections 5 and 6 of these Terms.
9. Intellectual Property
- Ownership: All content on the Service, including but not limited to custom product images, branding, logos, slogans, text, designs, and other materials (collectively, "Content"), is owned by My Material Warehouse or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
- Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Content without our prior written consent, except for personal, non-commercial use in connection with your purchase. You may use product names to describe purchased items but not our logos or images without consent.
- User-Generated Content: If you submit content to the Service (e.g., product reviews, photos), you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display such content for business purposes. You warrant that your content does not infringe third-party rights.
- Infringement: Unauthorized use of our Content or infringement of our intellectual property may result in account termination and legal action. To report infringement, submit a DMCA notice to support@mymaterialwarehouse.com with details of the alleged violation.
10. Third-Party Links and Platform
- Third-Party Links: The Service may contain links to third-party websites or services (e.g., payment processors, shipping providers). We are not responsible for their content, privacy policies, or practices.
- Platform Provider: My Material Warehouse's online store is built and operated on the Shopify e-commerce platform. By placing an order or using the Service, you acknowledge that certain aspects of the checkout, payment processing, and data handling experience are provided by Shopify Inc. and are subject to Shopify's own terms of service and privacy policy, available at shopify.com/legal/terms. We are not responsible for Shopify's platform availability, system outages, or any actions taken by Shopify in connection with your use of the checkout or payment functions. In the event of a conflict between these Terms and Shopify's platform terms as they relate to your transaction with us, these Terms govern the commercial relationship between you and My Material Warehouse.
11. User Conduct
You agree not to:
- Use the Service for unlawful purposes.
- Submit false or misleading information.
- Interfere with the Service's functionality (e.g., hacking, introducing viruses).
- Infringe our intellectual property or that of others.
We may suspend or terminate your access for violating these Terms.
12. Force Majeure
My Material Warehouse shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from causes beyond our reasonable control.
- Covered Events: Force majeure events include, but are not limited to: acts of God (e.g., hurricanes, floods, earthquakes, severe weather), pandemics or public health emergencies, acts of government or regulatory authority, war, terrorism, civil unrest, fire, labor strikes or disputes, supply chain disruptions, carrier failures, port closures, or other events outside our reasonable control.
- Effect on Orders: In the event of a force majeure, we will notify you as promptly as practicable and will make reasonable efforts to fulfill your order once normal operations resume. Estimated delivery times may be extended, and we are not liable for any damages, losses, or costs resulting from such delays.
- Cancellation Rights: If a force majeure event prevents us from fulfilling an order within a reasonable timeframe, either party may cancel the affected order. In such cases, you will receive a full refund of any amounts paid for the unfulfilled portion of the order.
13. Limitation of Liability
- Warranties: My Material Warehouse is a reseller and does not offer any product warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Any warranty applicable to a product is provided solely by the manufacturer of that product. It is your responsibility to review the manufacturer's warranty documentation prior to purchase. All warranty claims must be directed to the manufacturer. We will make reasonable efforts to assist you in identifying the appropriate manufacturer contact, but we are not a party to any manufacturer warranty and bear no obligation or liability under it. The Service and products are otherwise provided on an "as-is" basis.
- Liability Cap: To the fullest extent permitted by law, our liability for any claim arising from your use of the Service or products is limited to the amount you paid for the product.
- No Consequential Damages: We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss).
- Product Use: Products, including chemicals and mechanical and electrical components, must be installed by qualified professionals and in accordance with any applicable local building codes. We are not liable for damages due to improper installation or misuse.
14. Indemnification
You agree to indemnify and hold My Material Warehouse, its affiliates, officers, directors, employees, and agents harmless from any claims, losses, or damages (including legal fees) directly caused by your use of the Service, violation of these Terms, infringement of third-party rights, or improper use of our products, excluding our negligence.
15. Privacy
Your personal information is handled per our Privacy Policy at https://mymaterialwarehouse.com/pages/privacy, which outlines how we collect, use, and protect your data.
16. Governing Law and Disputes
- Governing Law: These Terms are governed by the laws of Florida, USA, without regard to conflict of law principles. For international orders, local consumer laws may apply where mandatory.
- Dispute Resolution: Disputes shall first be submitted to mediation in Tampa, Florida, under the American Arbitration Association rules. If unresolved, disputes will be resolved in the state or federal courts of Tampa, Florida. You agree to submit to their exclusive jurisdiction.
17. Termination
We may terminate your access to the Service at any time for violating these Terms. Provisions such as intellectual property, liability, and indemnification survive termination.
18. Product-Specific Terms
- Adherence to Building and Safety Codes: Products must be installed by licensed professionals in compliance with local codes and safety regulations. Customers must verify product suitability for their intended use. We are not responsible for damages or injuries resulting from improper installation or use.
- Product Accuracy: We strive to ensure product descriptions are accurate, but do not warrant error-free information.
19. Accessibility
My Material Warehouse is committed to ensuring that our website is accessible to all users, including individuals with disabilities. We believe in equal access to information and the ability to purchase our products regardless of a user's abilities or the assistive technologies they rely on.
- Platform and Standards: Our website is built on the Shopify e-commerce platform, which is designed with accessibility in mind and incorporates features aligned with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA — the recognized international standard for web accessibility. While Shopify provides a generally WCAG-aware foundation for our storefront and checkout experience, we have made additional efforts to test and review our site content to support accessibility across our product pages, navigation, and supporting information.

20. General Provisions
- Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy and any policies or pages expressly incorporated by reference (including our Returns Policy), constitute the entire agreement between you and My Material Warehouse with respect to your use of the Service and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral, relating to the same subject matter. No prior email correspondence, quote communication, or sales discussion shall modify or override these Terms unless confirmed in a separate written agreement signed by an authorized representative of My Material Warehouse.
- No Waiver: Our failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any future occasion. No waiver of any term shall be effective unless made in writing and signed by an authorized representative of My Material Warehouse.
